Welcome to Calwisher (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your access to and use of our calendar platform, available worldwide via our website and mobile applications (collectively, the “Services”). By using the Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Eligibility & Acceptable Use

  1. You must be at least 13 years old (or the minimum digital consent age in your country). Users under 18 must have parent/guardian consent and supervision.
  2. You agree to comply with all applicable laws of your jurisdiction, including, where relevant: India’s IT Act 2000 & IT Rules 2011, EU GDPR, UK GDPR, US CCPA/CPRA and COPPA, and other local consumer/data laws.
  3. You will not misuse the Services, attempt unauthorized access, interfere with operation, or engage in unlawful, harmful, or fraudulent activities.

2. Accounts & Security

  1. Some features require an account. You agree to provide accurate, current, and complete information and keep it updated.
  2. You are responsible for maintaining the confidentiality of your credentials and for activities under your account.
  3. We may suspend or terminate accounts suspected of violating these Terms or applicable laws.

3. Services & Content

  1. The Services provide global date information, holidays/festivals, reminders, e-greetings, and related insights.
  2. We strive for accuracy but do not guarantee content (e.g., holidays, observances, regional variations) will be error-free or available at all times.
  3. You are solely responsible for content you create, upload, or send (including e-greetings). Content must not be illegal, offensive, infringing, or deceptive.

4. Intellectual Property

  1. The Services (including software, design, text, graphics, and branding) are owned by Calwisher or its licensors and protected by applicable IP laws.
  2. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, lawful purposes.
  3. You may not copy, modify, reverse engineer, distribute, sell, or create derivative works without prior written consent.

5. Privacy & Data Protection

  1. Your use is subject to our Privacy Policy, which explains what data we collect, why, and how we process it.
  2. We align our practices with applicable global standards, including: India (IT Act 2000 & IT Rules 2011), EU GDPR, UK GDPR, US CCPA/CPRA and COPPA (as applicable), and other local laws.

  4. We implement reasonable security safeguards; however, no system is fully secure. You use the Services at your own risk.

  1. The Services are provided “as is” and “as available” without warranties of any kind, express or implied (including accuracy, reliability, or fitness for a particular purpose), to the maximum extent permitted by law.
  2. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for missed reminders, incorrect holidays, or content errors.
  3. Some jurisdictions do not allow certain exclusions/limitations; in such cases, our liability is limited to the maximum extent permitted by that jurisdiction.

10. Indemnity

You agree to indemnify and hold harmless Calwisher, its founders, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your use of the Services, your content, or your breach of these Terms or applicable laws.

11. Termination

  1. We may suspend or terminate your access if we believe you have violated these Terms or applicable laws.
  2. Upon termination, your right to use the Services ceases immediately; sections intended to survive (e.g., IP, indemnity, limitation of liability, governing law) will continue.

12. Governing Law & Jurisdiction

  1. These Terms are governed by the laws of India.
  2. All disputes are subject to the exclusive jurisdiction of the competent courts in Saharsa, Bihar, India.
  3. Users outside India may retain non-waivable rights under their local consumer or data protection laws.

13. Changes to These Terms

  1. We may update these Terms from time to time. The latest version with effective date will be posted within the Services.
  2. Your continued use after changes become effective constitutes acceptance of the revised Terms.
